It’s high time the high court takes Justice Thomas’ advice and adjudicates this dubious practice. It makes it impossible for any executive to govern. Trump, and the absolute will of the people, is being thwarted and it’s way past time that John Roberts steps in and calls foul. I know he avoids this most important of his duties, but if he doesn’t want to, then he needs to relinquish his chief justice post and give it to Thomas, who’s not afraid to step into the fray.
I don't see you mentioning it but I think you can reduce the impact of TROs by requiring that such orders, in addition to being heard by a 3 judge panel, be required to have a unanimous agreement that the TRO is necessary.
That's not the way as Congress is paralyzed by partisanship. Counter it by reciprocal judge shopping with national injunctions revoking the leftist national injunctions.
You make a good point, Richard. I think that the problem would be getting it through the Senate. Probably only a massive PR campaign and political pressure on some senators would be the only answer unless it could be combined with some other bill that the Dems really want. That sort of political strategy is waaaay beyond my area of expertise, so I shall have to defer to others on it. as Dirty Harry said, “A man’s got to know his own limitations.“
I don’t think your proposed solution works because the chances of getting one district judge to enjoin the enforcement of another district judge’s ruling are about as close to zero as you can get.
A decent suggestion. And the let’s reduce the jurisdiction of the DC Courts. Merge DC into an adjacent Maryland District ? Appellate review of a DC case assigned, case-by-case, to a rotating list of the Nation’s Circuits? Move SCOTUS to Philadelphia, where our Declaration was made, and the Articles and Constitution were both written? (They can still do a ceremonial session or two in DC.)
